1. Scope
TrustedAuxiliary operates a credential-gated visibility board ("Board") for licensed businesses and verified operators. By accessing or using the site, you agree to these Terms.
2. Verification Disclaimer
TrustedAuxiliary verifies business existence and license status only. Verification confirms presence only. It does not assess competence, quality, pricing, insurance, bonding, background, legality of services, or outcomes.
Listings do not constitute endorsements, recommendations, guarantees, or professional advice. All engagements occur directly between parties. TrustedAuxiliary is not a party to any transaction.
3. Listings and Publication
Listings are reviewed prior to publication. TrustedAuxiliary may decline, remove, or restrict listings at any time to maintain Board standards and signal integrity.
Time-based listings expire automatically at the end of the purchased visibility window. Verified status is active only while the subscription is current and paid.
4. Payments, Refunds, and Chargebacks
Publication requires verification approval and payment. Fees are generally non-refundable once a listing is published.
If a submission is declined prior to publication, posting fees may be refunded at TrustedAuxiliary's discretion. Chargebacks, payment disputes, or abusive behavior may result in removal and permanent access restriction.
5. Acceptable Use
You agree not to submit content that is false, misleading, defamatory, illegal, harassing, or that violates any third-party rights. You agree not to scrape, harvest, bulk-export, or republish Board data without written permission.
6. Trademark and Brand Notice (Intent to Use)
TRUSTEDAUXILIARY™ and Trusted Companies Advisory Board are claimed as service marks used to identify source and origin of services. TrustedAuxiliary maintains bona fide intent to use certain marks in U.S. commerce and may pursue federal registration where appropriate.
No permission is granted to use TrustedAuxiliary marks without written authorization. Unauthorized use of confusingly similar branding is prohibited.
7. Intellectual Property
Site content, design, and branding are owned by TrustedAuxiliary or its licensors. You may not copy, reproduce, or create derivative works without written permission, except as allowed by law.
8. Mandatory Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. It affects your rights.
Agreement to Arbitrate. Any dispute, claim, or controversy arising out of or relating to these Terms, the site, the Board, verification, publication decisions, payments, or any communications with TrustedAuxiliary (collectively, "Disputes") shall be resolved by binding arbitration, not in court, except as provided below.
Arbitration Provider and Rules. Arbitration will be administered by JAMS under its applicable rules, as modified by these Terms.
Seat / Location. The arbitration shall be seated in Missouri, unless the parties agree otherwise. The arbitrator may conduct proceedings remotely where appropriate.
Individual Disputes Only; Class Action Waiver. Disputes must be brought in the parties' individual capacity. No class actions, collective actions, private attorney-general actions, or representative actions are permitted.
Injunctive Relief for IP/Brand Misuse. Notwithstanding the foregoing, TrustedAuxiliary may seek injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use of its trademarks, branding, or intellectual property, or to protect site integrity and security.
Time Limit. Any Dispute must be brought within one (1) year after the event giving rise to the Dispute, unless a longer period is required by law.
9. Limitation of Liability
To the maximum extent permitted by law, TrustedAuxiliary is not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, data, or goodwill. TrustedAuxiliary is not liable for disputes between listed parties.
10. Modifications
TrustedAuxiliary may update these Terms at any time. Continued use of the site after changes constitutes acceptance.
